Getting health insurance in the name of another person

Question

is it permissable to have perscription medication written in the name of another person who has medical insurance that will cover the cost of the medication, but the medicine is not for the person with insurance?

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

If this health insurance is a cooperative insurance, then its conditions should be fulfilled and it is not permissible to cheat in order to get the medicine in the name of another person. However, if this insurance is a commercial one and not a cooperative one, then this insurance is not permissible in principle because of the deceit that is in it as we previously clarified in Fatwa 82599.

Nonetheless, if a person is obliged to participate in this system, it is permissible for him to benefit from it only according to the amount that he had paid even by using the trick which you mentioned in the question.
