His company wants to buy him a car with a Riba-based loan

Question

I work in a pharmaceutical company where they take a loan from a bank with intrest and buy me a car , where the company will pay the bank as long as I am employed there.
And in case I left the company before the loan setellment I SHAL PAY THE BANK .
Should I take the car

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

If the loan contract is concluded under your name in a way that you are the borrower, and the company pays the loan instalments to the bank on you behalf, and when you leave work, you will be obliged to pay what remains from the payment, then this is a Riba–based contract between you and the bank. Therefore, you are not permitted to enter this contract; for more benefit, please refer to Fatwa 81662.

However, if the contract is concluded between the company and the bank, and the company does this regardless of your consent and whether or not you want the car, then in this case, it is permissible for you to accept the car. Nonetheless, if the company borrows the money from the bank based on your consent and your wish for the car, then it is not permissible for you to ask this from the company as this leads the company to borrow money with Riba.
