Wants to use interests to buy gold for his sister whose gold was stolen

Question

My brother left home and take my sister gold along with him who is married, now parents are forcing me to make her new gold jewellry bcoz if her in-law come to know about this then there will be a big problem.
I have some interest amount around 6000 Indian rupees in my saving account, I have to pay a big amount to buy a gold for my sister. So my question is can i use that amount to buy a gold for my sister?

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

First of all, it should be noted that it is not permissible to deal with banks that deal with Riba (interest and/or usury) or to open a saving account which draws interests; for more benefit, please refer to Fataawa 84525 and 90054.

As regards buying gold for your sister with these interests, then this is not permissible, rather, you should get rid of these interests by spending it on the general benefit of the Muslims or on the poor and needy people as clarified in the above-referred Fataawa.

You should know that you are not obliged to obey your father in buying that gold with your own money, but if you do so, this is being kind and dutiful to your father and being kind to your sister and helping her get out of her difficulty; this is indeed among the best deeds beloved by Allaah.

With regard to paying the interests that you mentioned to your sister, then this is not permissible even if the parents order you to do so as neither you nor your parents own this money. Rather, it should be given to the poor or to the general welfare of the Muslims.
