Fatwa CenterReturning to a non-practicing husband who married a Christian woman
Question
aslamu alkum could i get answer for this question my husband divorced in few months before then he married another christain lady he live with her now days he want to keep me as a second wife ... is it allow for islam ? he have one christain wife and he is not folow even prayer on proper time ... he is not follow other islamic rulles also this circumstance i can take him back as husaband or can i reject his request is it sin for me? please help me to answer this question in my emil please (khkandyl@yahoo.com)
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad 
is His slave and Messenger.
If that divorce is not the third divorce and you are still in your waiting period from a revocable divorce, then you are obliged to go back to your husband if he wishes to take you back and you have no choice to refuse. However, if your waiting period has expired, then you are not obliged to go back to him but it is permissible for you to do so provided a new marriage contract is conducted. For more benefit on the kinds of divorce, please refer to Fatwa 82541.
The fact that he married a Christian woman is not an obstacle to your going back to him.
Nonetheless, there is no doubt that his negligence about his religious matters, especially the prayer, is very serious; for more benefit on the ruling of a person who abandons the prayer, please refer to Fatwa 85264.
Therefore, he should be advised about this with wisdom and good admonition as he might repent. If he repents, praise be to Allaah, but if he persists in his misguidance, then it is more appropriate for you not to go back to him and Allaah may bless you with a better husband.
However, you are not sinful if you do not go back to him, because after the elapse of your waiting period, he becomes a non-Mahram to you, and he is like any other man who proposes to marry you.
Finally, it should be noted that it is permissible for a Muslim man to marry a woman from the People of the Book if she is chaste as we clarified in Fatwa 82922.
