Her husband said to her ‘I am giving you divorce’

Question

AoA.my husband said to me i m giving u divorce he said just 1 time bt after few days he repeatd nd said to me divorce two times.nw i want to ask we r still husband nd wife or not??

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

The statement of the husband to his wife ‘I am giving you divorce’ in the present continuous tense is a promise of divorce and divorce does not take place with it even if he repeated it more than once unless he had the intention of divorce. For more benefit in this regard, please refer to Fatwa 128967.

As regards your statement after that ‘he said to me divorce two times’, if you mean that he uttered it two more times or that he repeated the word divorce twice, then you did not mention to us the wording that he used in telling you divorce. Therefore, we advise you to take your case to an Islamic Centre in your country or that you present the case orally to a scholar so that he could issue a Fatwa to you according to what really took place.
