Unjustly preventing a person from performing Hajj

Question

Assalamu Alaikum, One of my friends went to Saudi for employment. Because of the ill treatment from the Muslim Employer he wished to stop and back to India. By the time his employer did a 'Huroob' case (escaped from work) along with stealing in the immigration. He caught by polic and deported to India. My friend is a pious Muslim, he tried to do his work with perfection. After some time, Allah blessed him and becaame in good position. Then he wished to perform his Hajj. He applied and was not able to perform Hajj as his name was blacklisted in Saudi. Here who will be punishable before Allah? his employer? Saudi Rulers or himself? Jazakkallah

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

Whoever is prevented from performing Hajj or ‘Umrah is excused before Allaah The Almighty, and the sin is on the one who prevented him for no valid reason, or contributed in preventing him because of such false accusations, or exceeded the due limit of punishment to prevent a person who wants to perform Hajj and ‘Umrah from performing them.

Indeed, Allaah The Almighty dispraised those who avert people from the way of Allaah and Al-Masjid Al-Haraam, when He Said (what means): {those who have disbelieved and avert [people] from the way of Allaah and [from] al-Masjid al-Haraam, which We made for the people - equal are the resident therein and one from outside...}[Quran 22:25]
