Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

There is no blame on you to dislike your husband so long as he is in the state that you have described, because he, indeed, deserves to be disliked under Sharee’ah. No doubt, his statement: “What an unfair religion is that” is major disbelief that takes him out of the fold of Islam, we seek refuge in Allaah from that! Grave is a word that comes from his mouth, he tells but a lie. Allaah The Almighty Says (what means):

• {Indeed, Allaah orders justice.}[Quran 16:90]

• {It is Allaah who has sent down the Book in truth and [also] the balance.}[Quran 42:17]

The balance stands for justice. According to Qataadah, Mujaahid and Muqaatil may Allaah have mercy upon them justice is called balance because a balance is an instrument of fairness.

Allaah The Almighty also Says (what means): {And the word of your Lord has been fulfilled in truth and in justice.}[Quran 6:115] So, to accuse Sharee’ah of injustice is to attribute lies to the Book of Allaah The Almighty and the indisputably unquestionable facts of Islam. But he may mean, by this statement, that your understanding of Sharee’ah is far from justice.

Anyway, it is well-known that the disbelief of either of the spouses is enough to rescind their marriage. However, a certain person should not be judged as a disbeliever unless the conditions of applying disbelief to him are fulfilled and the impediments that prevent applying disbelief to him are removed. For further information, see Fataawa 87963 and 91707.

In any case, it is due on your husband to repent to Allaah The Almighty. We have previously clarified that your maintenance is due on him. He has no right to ask you to work and earn money, since your maintenance is due on him according to his ability. For further information, see Fataawa 91310 and 86646.

Allaah Knows best.
