Saying to one's wife 'You do not have any rights on me'

Question

Dear Brother/Sister. Assalaamu alaykum. If a man says to his wife, 'You do not have any rights on me,' does it count as divorce?

Answer

All perfect praise be to Allaah, The Lord of the worlds. I testify that there is none worthy of worship except Allaah and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

This expression is not an explicit statement of divorce, but it is a metaphor that may mean divorce. The scholars stated that the saying of the husband (to his wife), “I have nothing to do with you,” is a metaphor of divorce, which is close to the expression in the question. Since it is a metaphor, divorce does not take place unless the husband actually intended divorce by it.

Allaah knows best.
