Allowing Wine in BYO Restaurants

Question

Assalamualikum warahmatullahi wa barakatuhu.Is a halal restaurant allowed to have BYO ('Bring your own bottle', i.e. bringing alcoholic bottles along to be served at a restaurant)? Why or why not? Is the earnings will be halal ?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

It is not permissible for the owner of the restaurant to enable or allow someone to drink wine in his restaurant or to advertise for it. He is also not allowed to cater him when drinking it, in case he brings it, because this is considered helping him in evil and being pleased with it; Allah Says (what means): {And cooperate in righteousness and piety, but do not cooperate in sin and aggression. And fear Allah; indeed, Allah is severe in penalty.} [Quran 5:2]

The money that the restaurant owner receives in exchange for the service of drinking wine is an ill-gotten money.
