Question
If a man divorced his wife under the influence of (Sihir-Jin magic) is that divorce correct?
Answer
Praise be to Allah, the Lord of the Worlds; and may His blessings and peace be upon our Prophet Muhammad and upon all his Family and Companions.
If a person is in such a state of unconsciousness that he is not aware of his words or he is aware of his words but he finds himself forced to utter the words of divorce under the influence of magic that makes him unable to control his words, the divorce of such person is not effective. Thus, the same rule with a greater reason applies to the one whose mind is lost due to some magic. Since, in this case, his situation is similar to the situation of a compelled person, an insane one or an unconscious person.
Note that if one is conscious or aware of his words and his situation is under his control then he is responsible for his words. He is considered a normal person and held responsible for his deeds and actions.
