Getting rid of a house taken by usury

Question

I bought a house with money that I borrow from a bank so I heard many time that it was forbidden well I chose this way because I couldn’t have the possibility to rent been apartment I wanted to marry en mine parent’s house was too little for me en mine wife. I want to know if it's Haram of Halal, is it Riba?

Answer

Praise be to Allah, the Lord of the Worlds; and may His blessings and peace be upon our Prophet Muhammad and upon all his Family and Companions.

We ask Allah to enable you to do whatever He likes and whatever He is pleased with, and to help you adhere to His Shariah and seek Halal food and Halal dwelling and Halal of every affair of yours.

You must know that borrowing money with interest and usury is Haram, and you should not avail of it except for a necessity that could only be fulfilled with this loan.

If there is no necessity for this loan, or there is a necessity that could be met by having recourse to other permissible means, then it is forbidden to borrow money with usury and interest.

Therefore if you resorted to borrowing money with usury and interest with a necessity that could have been met by other means, then you have indeed availed of usury and interest and you have to repent to Allah from this. Allah Says (interpretation of meaning): {But whosoever repents after his crime and does righteous good deeds (by obeying Allâh), then verily, Allâh will pardon him (accept his repentance). Verily, Allâh is Oft­Forgiving, Most Merciful.}[5:29]. If you can get rid of this transaction that involved usury and interest by giving back the money you have borrowed and escape from the usury and interest, then you must do so, even if you have to sell your house.

Allah Says (interpretation of meaning): {….but if you repent, you shall have your capital sums. Deal not unjustly (by asking more than your capital sums), and you shall not be dealt with unjustly (by receiving less than your capital sums).}[2:279].

If not, then it is enough just to repent to Allah, and we ask Allah to enable us to do whatever He likes and is pleased with.
