Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

A wife will be admitted to Paradise or thrown to Hell according to her treatment to her husband; therefore, if she is negligent about his rights, this will be a reason for her to be thrown into Hellfire. For more benefit, please refer to Fatwa 85308.

If you really did to your husband what you mentioned in the question, then this is clear injustice which may incur the Wrath of Allaah on you. How could a woman do such things with a faithful husband, from whom Allaah blessed her with children? Hence, you are obliged to sincerely repent to Allaah. For more benefit on sincere repentance, please refer to Fatwa 83145.

Among the means or repentance is to give back to your husband the money which you took from him without right, and seek his forgiveness for being unjust to him and for wrongly accusing him. You should know that whoever repents, Allaah accepts his repentance and forgives him; because Allaah forgives all sins [except Shirk, i.e. associating partners with Allaah]. Allaah Says (what means): {But indeed, I am the Perpetual Forgiver of whoever repents and believes and does righteousness and then continues in guidance.}[Quran 20:82].

If it is true that your brother and cousin are urging you to ask for half of your husband's property or more than half, while you have no sound Islamic reason for asking this wealth, then you are obliged to advise them to repent to Allaah for every injustice they have done to your husband.

We do not know whether or not your husband uttered divorce to you, anyway, we advise you to reconcile with him, as reconciliation is good. We also admonish you to learn the religious rulings; especially that Allaah facilitated many means of seeking knowledge at this time and age.

furthermore, it should be noted that there are many disadvantages in residing in a non-Muslim country; therefore, if there is no necessity or dire need for a Muslim to reside there, he should migrate to reside in a Muslim country.

For more benefit on the prohibition of a wife mistreating her husband, please refer to Fatwa 87980, and Fatwa 90225 on the ruling of magic.

Finally, the two following matters should be mentioned:

1- If your husband is still in prison, then it is a condition for your repentance to be accepted to immediately endeavor to get him out of prison and drop your case against him.

2- If you are able to stop the effect of magic without resorting to magicians, then you are obliged to do so without resorting to them.

Allaah Knows best.
