Fatwa CenterHer husband kicked her out of his house and does not take care of her children
Question
I have been troubled by my husband since 14 years, he kicked me out of his hours with the 3 children, and now he is blaming me that i have ran from his house with his children, and jewels. But the fact was he had snached all my jewels and money with all the things given by my parents during the marriage. Everything is in his house, now he is asking me to take all the things from his house by paying him 3 lakhs in cas, he is not taking care of my kids or me, had not taken any sort of responsiblity. We have been splitted 3 years back. Pl i am in need of help according to islam law, i dont know what should i do pl suggest me. i am in my home town with my parents
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad 
is His slave and Messenger.
Spouses should have good marital relationships with each other, among which is that the husband should spend according to what is reasonable on his wife and his children and it is not permissible for him to refuse to spend on his wife unless she is recalcitrant, like if she denies him the right to have sexual intercourse with her or that she goes out of his home without his permission. For more benefit, please refer to Fataawa 88304 and 85012.
Hence, our advice is that some righteous people among your relatives or others should try to reconcile between you and your husband or to decide that you separate (by divorce) in case reconciliation is of no avail.
If this is not achieved, then it is the Muslim judge who would put an end to such a case where there are dispute and dissension, and if there are no Islamic courts in your country, then Islamic Centers would serve instead of the Islamic courts in studying your case.
