Question

Assalamwalaikum, Pls advise as to if it is right for a husband to stop talking to his wife for days (20 days till date) as he is angry for some reason?? My husband stays out of the country for work, and i stay with my mother-in-law & brother in law. now i am 7 month pregnant, & before conceiving we (both our families) had a fight or dispute over infidelity which was not completely true, however my husband forgave me & we stayed together for sometime as he had come home for his annual leave. but now i have come to my mother's place for delivery & over this topic the we again had arguments. which has lead him to stop talking to me & taking my calls. Please advise what should i do??? I need ur help pls help me. Allah hafiz.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

In principle, a Muslim is free from sin, so it is not permissible for a Muslim man to accuse his wife of something bad, especially if it is about her honor, except with evidence. For more benefit in this regard, please refer to Fatwa 87877.

Moreover, the wife has the right upon her husband to treat her in a kind and reasonable manner and he should have a good marital relationship with her as clarified in Fatwa 88304.

On the other hand, the Sharee’ah has clarified the reasons and method of deserting one’s wife, so the husband may desert her if she is recalcitrant according to specific steps taken sequentially; for more benefit in this regard, please refer to Fatwa 85402. Therefore, deserting one's wife by not speaking to her is something contradictory to the Sharee’ah.

Finally, the two following matters should be clarified:

1- Spouses should be wise when problems occur between them and they, as well as the in-laws, should be keen on maintaining good relationships between them.

2- The wife should avoid suspicious situations, especially when her husband is absent so that no one would suspect her. For example, she should wear Hijab when she goes out of her home, she should not go out except for a necessity, she should avoid mixing with men and so forth.

Allaah Knows best.
